Manufacturing, Design Defect Claims Dismissed in Illinois Mirena Action

CHICAGO — An Illinois federal judge has dismissed claims of defective manufacturing, design defect, and negligence claims asserted against Bayer Healthcare Pharmaceutical Inc. in connection with its Mirena device, ruling that they were inadequately pled.
However, in the June 5 order, Judge Jorge L. Alonso of the U.S. District Court for the Northern District of Illinois allowed the plaintiff’s misrepresentation claim to proceed to the extent that it refers to the device’s labeling and packaging.
