Medtronic Must Comply With Discovery Orders in Infuse Case, Hawaii Federal Judge Rules

HONOLULU — A Hawaii federal judge has upheld a magistrate judge’s order requiring Medtronic Inc. to produce communications with non-U.S. government agencies and documents relating to medical journal articles discussing the defendant’s Infuse device that were not read or relied upon by the plaintiff’s surgeon.
In the May 26 order, Judge Michael J. Seabright of the U.S. District Court for the District of Hawaii also affirmed that Medtronic must produce documents relating to its compensation of Dr. Kevin Foley, ruling that such evidence is relevant.
