SAN DIEGO — A California appeals court has upheld a $2.6 million verdict rendered against NuVasive Inc., which was accused of conspiring to misrepresent that its spinal surgery device was completely safe and would not cause nerve damage.
In the May 18 opinion, the California Court of Appeal, 4th District, found the record contains substantial evidence that NuVasive conspired with a surgeon to disseminate these misrepresentations regarding its NeuroVision device to the medical community and patients.
In September 2008, Dr. William Taylor performed spine surgery on Brenda Kitrosser at the University of California in San Diego (UCSD) using NeuroVision. …
