NEW YORK - Eight women are seeking $10 million in compensatory and $10 million in punitive damages from the manufacturers of DES for 'severe' injuries they allegedly sustained as a result of in utero exposure to the drug. Ami Ritter Kowalski, et al., v. Abbott Laboratories, et al., No. CV-02-6574 (E.D. N.Y.).
The Dec. 16 complaint claims that DES was a defective product, that the drug companies failed to warn consumers of the dangers of the drug, failed to adequately test the drug, and conspired to obtain FDA approval by misrepresenting the drug's safety.
