Defendants in DePuy Pinnacle Hip Implant Oppose Plaintiff Efforts to Protect Mental Health Records

DALLAS –– Defendants involved in the DePuy Orthopaedics Pinnacle Hip Implant national coordinated docket have opposed a plaintiff motion to obtain a protective order barring the production of mental health records, saying that the plaintiffs “have put their physical and mental conditions at issue in this litigation.”
In a May 18 response filed with the U.S. District Court for the Northern District of Texas, the defendants additionally argued that the bellwether plaintiffs had overlooked the “critical fact” that they had waived any privilege by signing a written release of the records.
