Plaintiffs Urge JPML to Transfer Bard IVC Filter Actions to One Court for Coordinated Pretrial Proceedings

WASHINGTON, D.C. — Plaintiffs in lawsuits involving C.R. Bard’s inferior vena cava filters have asked the Judicial Panel on Multidistrict Litigation to transfer the actions to Texas or Nevada for consolidated or coordinated pretrial proceedings.
In a May 15 brief, the plaintiffs assert that the 36 actions, which have been filed in 29 different federal courts, should be consolidated pursuant to 28 USC Section 1407 because they involve common fact questions as to design, safety, testing, marketing and performance of the IVC filters.
