BATON ROUGE, La. — Claims filed against C.R. Bard Inc. in connection with its inferior vena cava filter are time-barred under Louisiana law because the plaintiffs were aware of what caused their injuries by July 31, 2012, yet did not file suit until August 2013, a Louisiana federal judge has ruled.
On May 12, Senior Judge James Brady of the U.S. District Court for the Middle District of Louisiana noted that claims asserted under the the Louisiana Products Liability Act are subject to a liberative prescriptive period of one year, starting "the date the injury is sustained."
