N.J. Court Denies as Moot Efforts to Apply Ind. Law to Punitive Damage Claims in Ongoing Durom Hip Cup Trial

NEWARK, N.J. –– Efforts to have Indiana law applied to punitive damages in an ongoing Zimmer Durom Hip Cup trial have been denied as moot, according to a recent court order.

In a one-page order issued May 11, the U.S. District Court for the District of New Jersey wrote that the motion had been denied “as moot for the reasons set forth on the record.”

Christine Brady was implanted with Zimmer Inc.’s Durom Cup in August 2006. Six months after the surgery, Brady allegedly began experiencing an “unexpected gradual increase in pain.”
