Attorney Representing Biomet Hip Implant Plaintiff Says Defendant Didn’t Fulfill Mediation Requirement

SOUTH BEND, Ind. –– An attorney representing a plaintiff with claims pending in the national coordinated docket for Biomet M2a Magnum Hip Implant litigation has written a letter to the MDL judge, saying that the defendant’s mediation tactics were not in line with its obligation under the master settlement agreement.

In an April 24 letter written to Hon. Robert Miller of the U.S. District Court for the Northern District of Indiana, co-lead counsel for the plaintiffs said that the attorney has “misunderstood” a number of Biomet’s obligations.
