TIG Must Reimburse Stryker $6.2 Million for Uni-Knee Settlements, Mich. Federal Judge Rules

GRAND RAPIDS, Mich. — A Michigan federal judge has ruled that TIG Insurance Co. must pay $6,194,258 to Stryker Corp. for settlements it reached in cases involving its Duracon Unicompartmental Knee implant, which is the difference between what Stryker paid to settle the claims and the sum that fell within its self-insured retention.
In an April 29 order, Judge Robert Holmes Bell of the U.S. District Court for the Western District of Michigan further held that Stryker is entitled to statutory prejudgment interest from the time its claim for damages arose, on Feb. 9, 2009, and that penalty interest …
