Fla. Court Excludes Expert Testimony, Throws out EIUS Knee Implant Suit Against Howmedica

MIAMI –– A Florida federal court has awarded summary judgment to Howmedica Osteonics Corp. in a case involving its knee implant system after it determined that the testimony from the plaintiff’s lone expert witness was inadmissible.

In an April 20 order, the U.S. District Court for the Southern District of Florida said that even if the testimony had been allowed, the plaintiff had still failed to support her assertions or provide evidentiary support for her claims.

Plaintiff Sandra Witt initiated the lawsuit against Howmedica Osteonics Corp., contending that its EIUS Unicompartmental Knee System (EIUS) was defective. Witt eventually underwent a …
