BOSTON — Massachusetts’ highest court has upheld a $63 million verdict in a Children’s Motrin case, ruling that federal law did not preempt the plaintiffs’ failure-to-warn claims and that the plaintiffs adequately established that the drug caused their daughter to contract toxic epidermal necrolysis.
In an April 17 opinion, the Supreme Judicial Court of Massachusetts further held that the compensatory and loss of consortium damages were not excessive in light of the injuries sustained.
