TAMPA, Fla. — A trial court did not abuse its discretion in awarding C.R. Bard Inc. summary judgment in a G2 vena cava filter case on the basis that plaintiffs failed to present expert testimony establishing that the device was defective, the 11th Circuit U.S. Court of Appeals has ruled.
In a March 31 opinion, the appellate court ruled that the testimony of plaintiffs’ expert witness was properly barred on grounds that he lacked the requisite medical training and experience.
