Parties in Zimmer NexGen Knee Implant MDL Exchange Briefing on Validity of Rebuttal Reports

CHICAGO –– Zimmer Inc. and the plaintiffs involved with what is expected to be the first bellwether NexGen Knee Implant case to go to trial have exchanged briefing on the timeliness of a rebuttal report, with the defendant maintaining that a prior court ruling did not give the plaintiffs permission to disclose a new expert.

In a March 20 reply brief filed in the U.S. District Court for the Northern District of Illinois, Zimmer said the rebuttal report was filed five months after such reports were due and no argument justifies the late disclosure.
