PHILADELPHIA — A plaintiff’s claims that Avandia caused his cardiovascular injuries are time-barred under New York law because the plaintiff should have been aware of a link between his injuries and the drug by 2007, a Pennsylvania federal judge has ruled.
On April 9, Judge Cynthia M. Rufe of the U.S. District Court for the Eastern District of Pennsylvania awarded GlaxoSmithKline summary judgment on the claims of personal injury, breach of warranty and fraud.
