N.J. Judge Awards Roche Summary Judgment in Accutane Litigation, Says IBD Warnings Adequate

ATLANTIC CITY, N.J. — A New Jersey state judge has awarded Hoffman-La Roche Inc. summary judgment in the state's multicounty Accutane litigation, finding the drug’s post-April 10, 2002, warnings adequately warned of the risk of inflammatory bowel disease.

On April 2, Judge Nelson Johnson of the Atlantic County (N.J.) Superior Court, concluded that the warnings issued to doctors and pharmacists “very ably disclose with ample detail and intensity the risks associated with taking Accutane.”

According to plaintiffs’ counsel, 800 cases remain in which plaintiffs first ingested Accutane after April 10, 2002.
