JACKSONVILLE, Fla. — A Florida federal judge has allowed design and manufacturing defect claims to proceed against C.R. Bard in an inferior vena cava filter case, ruling that questions of fact exist as to whether the plaintiff’s injuries were caused by the device’s design and whether certain flaws in the device are manufacturing defects.
On March 30, Judge Marcia M. Howard of the U.S. District Court for the Middle District of Florida also denied Bard summary judgment on the plaintiff’s punitive damages claim, finding she presented sufficient evidence that although Bard was aware of the problems with the device’s predecessor, …
