MINNEAPOLIS — A Minnesota federal judge has dismissed without prejudice a manufacturing defect claim asserted against the makers of Advil by a man who alleges he contracted a life-threatening skin condition after taking the drug, ruling that the claim states only conclusions rather than facts.
However, in the March 27 order, Judge Ann D. Montgomery of the U.S. District Court for the District of Minnesota allowed a claim of willful and wanton negligence to proceed against Pfizer Inc. and Wyeth, ruling that the plaintiff adequately alleged that he was in a position of peril.
