Biomet M2a Magnum MDL Court Denies Plaintiffs’ Motion to Enforce Settlement Agreements

SOUTH BEND, Ind. –– The federal court overseeing the national coordinated docket for claims arising from allegedly defective Biomet M2a Magnum Hip Implants has refused to enforce a settlement agreement, finding that if the plaintiffs disputed the defendant’s reasons for seeking a reduction, their remedy was to proceed to mediation.
In the March 23 order, the U.S. District Court for the Northern District of Indiana explained that there was no evidence that the Release and Settlement Agreements were executed “in a form mutually agreed to by the Parties” before Biomet revoked the offers.
