CHARLESTON, W. Va. — Claims asserted against Boston Scientific Corp. in a Pinnacle/Solyx transvaginal mesh action are not time-barred under Arizona law because there is no evidence that the plaintiff ever linked her injuries to the allegedly defective devices, a West Virginia federal judge has ruled.
On March 16, Judge Joseph R. Goodwin of the U.S. District Court for the Southern District of West Virginia denied BSC’s motion for summary judgment, finding the plaintiff did not become aware of the possible cause of her injuries until after she underwent two revision surgeries.
