Zimmer Says Certainty Not Required to Start Louisiana’s Prescription Period in Seeking Dismissal of Durom Cup Suit

NEWARK, N.J. –– Certainty is not required to start Louisiana’s one-year prescription period, Zimmer has argued in a reply brief supporting its efforts to dismiss a Durom Hip Cup suit pending in the national coordinated multidistrict litigation docket.

In the March 5 brief, filed in the U.S. District Court for the District of New Jersey, the defendant said the record is “unequivocal” that plaintiff Christine Brady had “actual or constructive knowledge of both her injury and of the likelihood that it resulted from a defect in her Durom Cup implant by at least December 2008.”
