Ga. Federal Judge Allows Plaintiff to Cure Pleading Deficiencies in Pedicle Screw Complaint

SAVANNAH, Ga. — A Georgia federal judge has dismissed a defective pedicle screw complaint filed against Globus Medical Inc., explaining that the plaintiff failed to plead discrete claims in separate counts.
In a March 9 order, Judge William T. Moore Jr. of the U.S. District Court for the Southern District of Georgia found the amended complaint is essentially a “shotgun pleading” that does not identify the claims with sufficient clarity. However, the judge allowed the plaintiff to amend his complaint a second time.
