Judge Dismisses Lexapro Birth Defect Action So Plaintiff May Refile in Different Forum

CAMDEN, N.J. — A New Jersey federal judge has granted a plaintiff’s motion to dismiss her Lexapro birth defect action without prejudice so that she may refile her case in a different forum where it may be consolidated with similar cases.
On Feb. 25, Judge Robert B. Kugler of the U.S. District Court for the District of New Jersey noted that the action is still in its early stages and neither party has spent a significant amount of time and expense in its preparation.
