JPML Vacates Transfer Order in Case Involving NexGen Flex Articular Surface Knee Implant

WASHINGTON, D.C. –– The Judicial Panel on Multidistrict Litigation has vacated a conditional remand order transferring a NexGen Flex Articular Surface knee implant component action to the MDL docket, explaining that the MDL judge has previously determined that such cases do not fit the criteria for inclusion in the coordinated docket.

In the Feb. 4 order, the JPML noted that its centralization order stipulated that the cases share factual issues arising from Zimmer’s high-flex femoral components, specifically the Cruciate Retaining and Legacy Posterior Stabilized components and the Gender Solutions versions of the MIS Tibial component.
