NEWARK, N.J. — A plaintiff in a Durom Cup hip implant lawsuit is urging a New Jersey federal judge to allow a case-specific expert report that was served after the court-imposed deadline for such reports had passed, arguing that Zimmer still has ample time to depose the expert.

Zimmer, however, has opposed the plaintiff’s motion, maintaining that the plaintiff made a strategic decision not to have the expert examine her explanted device before the expiration of the deadline set by Judge Susan D. Wigenton of the U.S. District Court for the District of New Jersey.
