LONDON, Ky.-The wife of a man who died as a result of uncontrolled bleeding following emergency surgery cannot prove that Oxycontin 'masked' the symptoms of the illness and contributed to his death, the manufacturer's motion for summary judgment states. Couch v. Purdue Pharma, L.P., et al., No. 01- (E.D. Ky.).
Purdue Pharma, the manufacturer of the prescription pain reliever, states that the plaintiff cannot provide evidence to prove causation because the proposed experts were never asked to provide testimony in support of the widow's claims and stated in their depositions that the decedent's condition was not caused by Oxycontin.
