BENTON, Ill. — An Illinois federal judge has retained jurisdiction over a hernia mesh case filed against C.R. Bard Inc. and Davol Inc., finding the plaintiffs’ claims against the nondiverse healthcare defendants are untimely and must be dismissed.
On Feb. 17, Judge Staci M. Yandle of the U.S. District Court for the Southern District of Illinois found the claims asserted against the healthcare defendants under an “agent of sale and distribution” theory were filed after the four-year statute of limitations had expired.
