Zimmer, NexGen Plaintiffs Split on Selection of First Bellwether Trial

CHICAGO –– Zimmer and plaintiffs asserting claims in the NexGen Knee Implant Products Liability Multidistrict Litigation are split on what the first bellwether trial should be, with the defendant maintaining that its selection is representative “of the class of products that prompted the formation of this MDL.”

In the January briefs, filed in the U.S. District Court for the Northern District of Illinois, the plaintiffs urged the court to select Diano as the first case, while the defendant asked the court to choose Pudwill.
