Parties’ Request for Blanket Exclusion of Opinions, Testimony Denied in Bard Pelvic Repair MDL

CHARLESTON, W. Va. — The judge overseeing the C.R. Bard pelvic repair system multidistrict litigation has denied four omnibus motions seeking blanket exclusions of expert opinions and testimony, explaining that the court must assess the reliability and methodology underlying each opinion.
On Jan. 28, Judge Joseph R. Goodwin of the U.S. District Court for the Southern District of West Virginia held that at this point in the MDL, “a blanket exclusion of opinions and testimony would be inappropriate.”
Plaintiffs filed two omnibus motions to exclude certain opinions and testimony of Bard’s non-retained corporate experts and physician experts.
