CORPUS CHRISTI, Texas — A federal judge has awarded Reglan makers summary judgment on claims that they failed to warn of the risk of tardive dyskinesia associated with the drug, finding the plaintiffs failed to rebut the presumption of liability afforded to drug makers under Texas law.
On Jan. 27, Judge Nelva Gonzales Ramos of the U.S. District Court for the Southern District of Texas held that because the Food and Drug Administration has not found that the drug makers defrauded it, plaintiffs’ rebuttal fails.
