Ky. Court Denies Zimmer Efforts to Obtain Costs, Fees in Hip Implant Suit

ASHLAND, Ky. –– A Kentucky federal court has denied hip implant manufacturer Zimmer’s motion for fees and costs, finding that while counsel for the plaintiff did nothing to further the case, the defendant was the one who multiplied the proceedings.

In the Dec. 16 decision, the U.S. District Court for the Eastern District of Kentucky opined that a “cynic might suggest that Defendants counsel were paving the way for the instant motion.”
