NEWARK, N.J. –– A New Jersey federal court has granted Smith & Nephew’s motion to dismiss a hip implant case, but opined that the defendant would not be prejudiced if the plaintiffs were granted leave to amend.
In the Jan. 20 decision, the U.S. District Court for the District of New Jersey ruled that the plaintiffs hadn’t satisfied pleading standards under New Jersey’s Products Liability Act.
