NexGen Knee Implant Plaintiffs Move for Sanctions, Cite Incomplete Expert Reports

CHICAGO –– The plaintiffs in the Zimmer NexGen Knee Implant multidistrict litigation docket have moved for sanctions, saying that on four different occasions the defendant submitted “essential” information on the eve of an expert deposition, “leaving not time for plaintiffs to prepare.”

In their Jan. 16 brief filed in the U.S. District Court for the Northern District of Illinois, the plaintiffs said that Rule 26 is “crystal clear” in its requirement that litigants are to not only disclose the opinions of their experts, but also the basis and reasons for those opinions.
