WEELING, W. Va. — A West Virginia federal judge has awarded the makers of Lexapro summary judgment in a wrongful death case, finding that no issue of material fact exists as to whether the label in effect at the relevant time adequately warned of the risk of suicide.
On Jan. 16, Judge Irene M. Keeley of the U.S. District Court for the Northern District of West Virginia ruled that although the plaintiff’s claims are not federally preempted, the record is clear that the warnings were adequate and that the deceased read the package insert.
