Colo. Federal Judge Awards Takeda Summary Judgment in Actos Injury Case

DENVER — A Colorado federal judge has adopted a magistrate judge’s recommendation in an Actos case that Takeda Pharmaceutical North America Inc. be awarded summary judgment on claims that the diabetes drug caused a plaintiff to develop bladder and heart problems.

In a Jan. 5 order, Judge Philip A. Brimmer of the U.S. District Court for the District of Colorado found the plaintiff failed to present sufficient evidence to create an issue of fact as to causation.

Safdar Lilak sued Takeda Pharmaceutical North America Inc., alleging that Actos and related drugs caused him to sustain a variety of injuries.
