RICHMOND, Va. — A Virginia federal court did not err in dismissing a Dexilant injury case for lack of causation on the basis that the plaintiff may not present expert testimony because she failed to name an expert witness by the court’s deadline, a federal appeals court has ruled.
In a Dec. 15 opinion, the 4th Circuit U.S. Court of Appeals agreed with the lower court that because the plaintiff could not establish causation without expert testimony, Takeda Pharmaceuticals America Inc. is entitled to judgment as a matter of law
