W. Va. Federal Judge Disqualifies Plaintiffs’ Expert Witness in Bard Pelvic Mesh MDL

CHARLESTON, W. Va. — A West Virginia federal judge overseeing the C.R. Bard pelvic mesh multidistrict litigation has disqualified one of plaintiffs’ expert witnesses pursuant to the “bright-line” rule because he has previously served as Bard’s expert witness in similar Bard pelvic mesh cases.
In a Dec. 8 order, Judge Cheryl A. Eifert of the U.S. District Court for the Southern District of West Virginia further noted that the proffered expert had a close working relationship with Bard's counsel and received confidential information regarding the defendant’s litigation strategy.
