Mo. Federal Judge Remands Risperidone Case to State Court, Finds No Fraudulent Misjoinder

ST. LOUIS — A Missouri federal judge has remanded a risperidone injury case to state court, finding the claims of the non-diverse plaintiff were not fraudulently misjoined because his claims are “logically related” to the diverse plaintiffs’ claims.
In a Nov. 25 order, Judge Charles A. Shaw of the U.S. District Court for the Eastern District of Missouri noted that the plaintiffs allege they took the same drug that caused them to suffer a number of serious injuries, which are alleged to be the same.
