Zimmer Seeks Attorneys’ Fees, Expert Expenses in Recently Dismissed Hip Implant Suit

ASHLAND, Ky. –– Parties in a hip implant case pending in Kentucky federal court have exchanged briefing on attorneys’ fees and expert expenses, with Zimmer Holdings Inc. and Zimmer Inc. maintaining that they are entitled to such fees since the plaintiff failed to prosecute his own case.
In an Oct. 31 reply brief filed in the U.S. District Court for the Eastern District of Kentucky, the Zimmer defendants backed their motion for fees, saying that the plaintiff failed to disclose experts and take event “basic, essential discovery.”
