Howmedica Attacks Knee Implant Suit, Says Plaintiffs Lack Evidentiary Support for Claims

OCALA, Fla. –– Howmedica Osteonics Corp. has moved to dismiss a knee implant suit, maintaining that the plaintiff has failed to present evidence that would support her claims, which include negligent misrepresentation, design defect, negligence, and failure to warn.

In a Nov. 12 motion filed in the U.S. District Court for the Middle District of Florida, Howmedica said in part that the plaintiff has failed to specify any facts regarding the alleged misrepresentation and, further, that the design defect and negligence claims “lack even a modicum of facts.”
