Calif. Appeals Court Upholds $3.61 Million Transvaginal Mesh Verdict

FRESNO, Calif. — A California appeals court has upheld a $3.61 million award to a couple in a C.R. Bard transvaginal mesh case, finding the jury’s negligence finding was supported by substantial evidence and that Bard was not denied a fair trial.
In a Nov. 19 opinion, the California Court of Appeal, 5th District, also ruled that the plaintiffs are estopped from arguing that the jury was given incomplete instructions on their surgeon’s fault, which resulted in a reduction of the original $5.5 million verdict.
