Texas Federal Judge Retains Clinical Trial Case, Finds Healthcare Defendants Improperly Joined

CORPUS CHRISTI, Texas — A Texas federal judge has refused to remand a case in which a plaintiff seeks compensation from Gilead Sciences Inc. and his healthcare providers for injuries he allegedly sustained via his participation in a clinical trial, finding the non-diverse healthcare defendants were improperly joined.
On Nov. 6, Judge Nevla Gonzales Ramos of the U.S. District Court for the Southern District of Texas held that because Ramos disclaimed any action under the Texas Medical Liability Act, he has no cause of action against the healthcare defendants.
