ORLANDO, Fla. — State-law strict liability claims asserted by a Florida man who says he was injured by the Cormet Advanced Hip Resurfacing System are federally preempted because they seek to impose requirements that are “different from, or in addition to” federal regulations.
In a Nov. 7 order, Judge Roy B. Dalton Jr. of the U.S. District Court for the Middle District of Florida allowed the plaintiffs to amend their complaint to assert a state-law claim that is parallel to federal law.
