RENO, Nev. — A Nevada federal judge has dismissed fraud, RICO, consumer protection and unjust enrichment claims brought against Eli Lilly & Co. in connection with Zyprexa, ruling that the pro se plaintiff failed to plead sufficient facts to support his claims.
In a Nov. 7 order, Judge Larry R. Hicks allowed the plaintiff to amend his complaint to adequately support his claims.
Zyprexa, an antipsychotic drug, has been approved by the Food and Drug Administration for the treatment of schizophrenia and bipolar disorder.
