Ga. Federal Judge Allows PerFix Plug Hernia Mesh Lawsuit to Proceed Against C.R. Bard

STATESBORO, Ga. — A Georgia federal judge has denied C.R. Bard Inc.’s motion to dismiss a hernia mesh lawsuit, finding the plaintiff adequately pled claims of design defect, failure to warn and punitive damages.
On Oct. 14, Judge B. Avant Edenfield of the U.S. District Court for the Southern District of Georgia explained that the complaint specifies nine alleged defects in bard’s Mesh PerFix Plug device and therefore meets Georgia’s pleading standards.
