Vt. Federal Judge Issues Expert Testimony Rulings in Botox Seizure Case

MONTPELIER, Vt. — A Vermont federal judge has refused to exclude the testimony of Allergan Inc.’s expert in a Botox case, finding that the expert relied on sufficient facts and data in forming his opinion that there is no established link between the botulism drug and seizures.
In an Oct. 23 order, Judge William K. Sessions of the U.S. District Court for the District of Vermont also denied Allergan’s motion to exclude plaintiffs’ FDA and causation experts, finding they are qualified and their opinions are sufficiently reliable.
