TAMPA, Fla. — A Florida federal judge has remanded to state court a transvaginal mesh lawsuit filed against Boston Scientific Corp., Ethicon Inc. and certain of their sales representatives, finding the non-diverse defendants were not fraudulently joined.
On Sept. 26, Judge Virginia M. Hernandez Covington of the U.S. District Court for the Middle District of Florida held that the plaintiff has a reasonable possibility of stating a valid cause of action against the sales representatives, who, like the plaintiff, are Florida residents.
