N.M. Mesh Case Stayed Pending JPML’s Decision to Transfer to the Ethicon MDL

ALBUQUERQUE, N.M. — A New Mexico federal judge has stayed an Ethicon pelvic mesh case pending possible transfer to the multidistrict litigation, ruling that a stay of proceedings will prevent duplicative and possibly inconsistent rulings on the issue of fraudulent joinder of non-diverse plaintiffs.
On Sept. 16, Judge Kenneth J. Gonzales of the U.S. District Court for the District of New Mexico further held that plaintiffs will not be prejudiced by such a stay.
