JACKSON, Miss. — A Mississippi federal judge has awarded the makers of Reglan summary judgment on a misrepresentation claim in light of the 5th Circuit’s recent ruling that brand name drug makers cannot be held liable where the plaintiff ingested only the generic form of the drug.
In a Sept. 11 amended order, Judge David Bramlette of the U.S. District Court for the Southern District of Mississippi adopted the 5th Circuit’s holding that the Mississippi Product Liability Act shields brand manufacturers "from liability for products they did not create."
