SAN FRANCISCO — DePuy Orthopaedics Inc. has asked the state court judge presiding over California’s coordinated ASR XL hip implant docket to deny a proposed re-transfer of claims filed by plaintiffs who opted out of the national settlement program created for those injured by the device.
In a brief filed Aug. 14, the hip implant manufacturer insists that California law governing coordinated proceedings like the one established for ASR claims in San Francisco Superior Court mandates that the opt-outs remain on the docket until they are ready for trial.
